Consistency consultation published

Defra has published the delayed (because of local elections) Consistency consultation for England. This needs to be considered alongside the EPR and DRS consultations which were published in March with a closing date of 4th June.

The consultation is primarily about the requirement for specific materials to be collected separately for recycling from 2024.

For household waste, the requirement for local authorities will be to separately (from residual waste) collect the following:

  • glass bottles and containers – including drinks bottles, condiment bottles, jars
  • paper and card – including newspaper, cardboard packaging, writing paper
  • metal packaging – steel and aluminium tins and cans
  • plastic bottles – including clear drinks containers, high-density polyethylene (HDPE; e.g. milk containers), detergent, shampoo and cleaning products
  • plastic pots, tubs, trays
  • foil, foil trays and metal aerosols cans, including packaging items •
  • food and drink cartons
  • plastic film and flexible packaging (from 2026/27
  • food waste (separate to garden waste and at least weekly)
  • possibly garden waste

For business waste, the requirement will be for businesses to put out for separate collection and waste companies to collect separately:

  • Glass bottles and containers – including drinks bottles, condiment bottles, jars
  • Paper and card including newspaper, cardboard packaging, writing paper
  • Metal
    • Steel and aluminium tins and cans
    • Foil, food trays and metal lids
    • Steel and aluminium aerosols
    • Aluminium tubes (e.g. tomato puree tubes)
  • Plastic
    • Plastic bottles – including clear drinks containers, HDPE (milk containers),
    • detergent, shampoo and cleaning products
    • Plastic pots tubs and trays
    • Food and drink cartons
    • Plastic films
  • Food waste

The consultation needs to be read in detail to understand how these requirements are expected to be financed (for local authorities), implemented and regulated and how the collections of drinks containers and packaging will work alongside DRS and EPR.

Responses are required by 4th July.
